I've read the entire trial transcript and when you look at the timeline, it does make sense.  It's very lengthy but Gerald was out of hte country when he realized Rafiel was going to literally get a way with murder.  Rafiel also orginally told Gerald it was self defense.  Once Gerald realized after Rafiel hadn't even been questioned about it, and Rafiel was lacking any real remorse, Gerald knew he had to come forward.  Also, he knew that Rafiel wasn't exactly acting alone so police worked with Gerald to record phone conversations, etc.

Yeah, way more details need to be provided. Not only did he shoot the guy with a gun, but he shot him with a freaking assault rifle. Very often when people have guns, they don't know how to act right. Pulling a gun should never cross your mind if you feel violence is about to go down - it should only cross your mind if you feel like you might get killed. It sounds like he just fucked up real bad and got it into his head to pull out the gun, and from there he pulled the trigger.

Okay, I just read the actual article which lists his justification for pulling the gun: "Strebendt shot Crofut in self-defense after Crofut told him that he was armed and threatened to kill him." - that's what Strebendt's attorney said. It seems like this guy is completely screwed. Like, how are any witnesses going to help? You don't fucking pull a gun because some drunk asshole is talking shit. Unfortunately, he fucked up and killed the guy, and now he's in this situation.

Well, it sounds like the guy was drunk and upset. Even if he did say that, you don't just pull out an assault rifle. He could've gone back to his car and had the gun ready in his hands (while watching to see if Crofut really had a gun) or he might've been able to just drive away. At the end of the day, he killed an unarmed drunk guy. I don't know why his lawyer thinks he's not going to jail. Dumb attorneys always want their client to do a plea deal, but in this case, that really is the best advice.

shaking my head sounds like he has made poor judgement calls which both directly and indirectly resulted in the needless deaths of two people. Why didn't he call the cops and report the guy offered him cash right then and there in 1st place? guy might still be alive today.

Why didn't he tell the drunk 53yo "yeah, i will wait here why you go to your car". Then immediately get in his car and drive away, thus escaping this situation.

Story doesn't make any sense.
-Why didn't he run to the unarmed 53 year old and subdue him instead of running to his truck for a gun?

-He is a former Marine Sniper, why didn't he get his gun and hold the guy at gunpoint instead of shooting him?

-If he HAD to shoot him, why didn't he shot to maim(in the leg) instead of shooting to kill?


IIRC, his defense was something like "If a man chases you down, threatens to kill you, and tells you he has a gun, you're allowed to take him at his word".

As a former cop, do you think that will hold up?

I get the whole incident with the car, but Gerald shot the guy after they had pulled over and were both out of their vehicles. Maybe it would be justified if the guy said he had a gun and made a move as if he were going for it. That said, he didn't have a gun (but Gerald would have no way of knowing that).

I think the 911 call could tell a lot, but Gerald's attorney made the call not to release it to the public. That seems to indicate that it won't help his case.

Also, there is an eye witness who is the wife of the guy that got shot, and I haven't seen any statements from her.

Wasn't there some guy on the OG who said Sterndt works for some Mafia guy who wants his uncle's land?
