A guy died from not being able to breathe after he was telling cops he couldn’t breathe.

No, it doesn't.

You should stop saying.

Who is it?

Actually,  no. It means you're expelling breath.  It doesn't necessarily mean you're taking in enough oxygen.  Likely he was panicking due to a constriction of his diaphragm. I don't know the context here, but nothing I seems appears immediately alarming about this use of force.

It's a silly saying. It's like saying anyone who can scream "I'm drowning!" clearly isn't drowning... yet.

That said, this guy was being a drama queen IMO. He was resisting despite saying he wasn't.

Looks like he went out from a blood choke or blood pressure drop not a lack of oxygen

The Leg Collector -

I side w cops 99% of the time but why did they slam him? He was cuffed already. Maybe he was being stiff and wouldnt walk to truck? Also, Eric Garner didnt die from being choked. He died because he was morbidly obese and had a heart attack due to forcing officers to get physical w him because he was resisting and non compliant.

Could be he was passively resisting going to the truck so they were going to hog tie and carry him. He was being a giant baby already so wouldn't surprise me.

Ah...I see.   So he would have died at exactly the same time even if the cops had never interacted with him?

Because 90% of cops are mean tempered rule crazy assholes.

That is not what he said, so why would you ask him that?

The cops choking him contributed to his death.  Had the cops never choked him, he wouldn't have died.   Who cares if the actual cause of death was a heart attack?  If the cops wouldn't have choked him, he wouldn't have had a heart attack.   The cops' actions led to his death.

Had the cops left him alone, he wouldn't have died.  Unless, as I asked, he really thinks that Garner would have dropped dead from a heart attack had the cops not choked him.

Lol he caused his own demise by forcing cops to get physical w him when his body couldnt handle that kind of exertion. It was reported that he would be exhausted from simply walking down the street. All he had to do was comply.

All the cops had to do was step back and deescalate the situation.   They were way too heavy handed, then ignored his pleas for help when he said he couldn't breathe.

The Leg Collector -

The choke had nothing to do w his death. If you trained at all youd know that. It was listed in the coroners report because of the video evidence so it had to be listed as a "factor." Coroner would have never known about the choke had the incident not been recorded. The choke was on for like 3 seconds. He died because he was morbidly obese with a heart like a cannes ham.

I'll ask you again, if the choke had nothing to do with his death, would he have died at exactly the same time if he had not been choked?

You could say the same thing about someone shooting at cops who gets shot.

Well, if the cops had not shot back, he would not have died.

The question is whether the cops should have "left him alone" not what would have happened if they had. The cops could leave everyone alone 100% of the time and we would have no death by cops... but we would also have a pretty shitty society.

And a lot of us care what the cause of death was since the media narrative was he died by being choked. He didn't.

We can also flip everything you said around:

You can also say had he just complied he wouldn't have died. His resisting led to his death. Had he not resisted, he wouldn't have died. Unless, you really think Garner would have dropped dead from a heart attack had he not resisted.

And on and on and on...

So again it comes down to was he doing something illegal, was he legally detained, did he then illegally resist, was the force used reasonable in proportion to his resistance?

Yes, yes, yes and yes. Justified. Fake Pie, OG Esq.

With the exact same physical interaction, minus the chokehold, yes he probably still would have had the heart attack from the physical wrestling.

Completely different situation.

If someone's shooting at you, you have the right to shoot back.  In Garner's case, they could have stepped back for a second and attempted to deescalate the situation.  He wasn't shooting at anyone.
