Family files wrongful death suit against Hernandez

While Aaron Hernandez sits in a jail cell awaiting the trial he'll face for the alleged murder of Odin Lloyd, the former Patriots tight end and his representatives are still trying to collect the money they believe New England owes him.

In October, the NFLPA filed two grievances to get the Patriots to pay Hernandez's salary from 2013 and 2014 (worth about $3 million) and the $3.25 million signing bonus he was due to receive next March.

This week, though, Lloyd's family filed a wrongful death suit against Hernandez, and it's asking a judge to grant a restraining order that would prevent the Patriots from paying out any money to Hernandez, according to the Fall River (Mass.) Herald News.

Furthermore, the newspaper writes, "the Lloyd family is requesting a restraining order for a real estate attachment up to $5 million that would prevent Hernandez from placing his spacious North Attleboro home beyond the court's reach for purposes of awarding damages."

A hearing is scheduled for Thursday.

The filing alleges that Hernandez "maliciously, willfully, wantonly, recklessly or by gross negligence caused Odin Lloyd to suffer personal injuries that directly resulted in his death."

Hernandez has pleaded not guilty to first-degree murder and five gun charges.

Smells like OJ all over again.

Ill never understand why someone who has reached that pinnacle of athletics and fame would even be remotely bothered to be included in such behavior. Does he think that he won't be found guilty? Even if he wasn't part of it and knew about it and didn't do anything about it he deserves jail time. Also what a joke it is for him to petition to be given a signing bonus that he never earned by not playing. It's a flawed system if this is allowed. Wrong on so many levels. Phone Post 3.0

It's the lifestyle he knew. Dude was a thug at Florida, probably a thug before he got to Florida, and a thug with money and fame is still a thug.

Fuck the "justice system", unions and all that BS. So the guy is in prison awaiting trial for murder and Patriots should pay him??? And so money hungry lawyers make sure the victim's families try to have a money grab... before the man is even proven guilty? Can't wait till then? And why does everything has to last years besides making ton of doe for lawyers and judges? So sick of it all.

is there such a thing as a rightful death lawsuit?

While I agree with you about the whole union business trying to get him paid while he's in jail awaiting trial for murder, I don't see any reason why not to file a wrongful death lawsuit. The burdens of proof are different - you don't have to be proven guilty to be found liable.

im hearing rumblings he may actually get off...if so does he play in the nfl again?
