Kicking a downed opponent scenario question

The fighter on top has knee on belly during an mma fight, only the balls of his feet touching the mat and no knee on the mat whatsoever. Is it legal under unified rules for the opponent on the bottom to upkick the fighter on top (once he shrimps his hips for space) in the face because his knees aren't on the floor?

Saw a flexible guy at training nail a sparring partner (wearing headgear) with this and wondered what the legality was?
