As pretty much everyone in MMA knows my school has been called Next Generation since 1998 when I opened up my first school. Since then I have opened schools and or LET schools be affilliated with Next Generation in Ireland, England, Canada, Arizona, California, and Texas. In Kelowna I have an instructor who does not use the name becuase he had his own name prior to affilliating with me (Toshido MMA) and that is perfect. In Vancouver I had an affilliate school that used the name Next Generation Canada and recently they split. Well one guy is staying affilliate with me and the other decided not to. BUT he think's it's cool and ok and ethicly ok to use Next generation Canada without the affilliation. NOW don't you think he could come up with his own name and not try and ride off mine? The guy is now having the balls to not say he was never affiliated with me in the first place and so now I have to take legal action. This shit has happened before with other schools in the US that are no longer NG's because of my attorney sending letters but it is a big waste of money since they can just stop ripping off my name and use another. Anyway I was just venting here because I know that a lot of people from Vancouver post here and I guess I will now take legal action. Thanks

It probably depends on the level of success of the name being used whether its legal or not. Remember all the places in Vancouver that had to change shit because of the Olympics?

2 issues here. Legal: did you register this as a trade name across Canada (it is a Provincial matter)? I would be surprised if you did as Next Generation is not distinct, which is a pre-requisite.
Commercial: how many times did you go Vancouver and teach classes, do grading, etc? If you did nothing to earn your own affiliates respect, why should the rest of us care if they don't want to change the name after leaving you?
I went there on 3 different occasions to teach seminars n belt guys. It's not registered across Canada but because I have been shipping across the border to Canada n I even have old news sections from my website congradulating them on the affilliation to my schools and on my site calling it next generation Canada. And the guy who's staying affilliated with me should be the one that keeps the name not the other one. The falling out was between the two of them not me. The one keeping the affilliation will still be next generation Canada. Anyway Im in process of taking care of it thanks
