OG legal heads help!! Being harassed by la

im stupid and I don't know much about law so I would appreciate some advice from those who do on a situation I am in.

i sell heating equipment for a company, I am mostly dispatched in situations where the potential customer has called in and thier gas has been shut off For red tag violations and need a replacement very quickly, as I am trained as a technician and can properly price out the extra work involved on red tag issues better than most sales guys who have no technical training.

last month I was dispatched to a lawyers house who had his gas shut off and needed a new one installed asap, I gave him his options and his prices and he purchased one using his credit card and it was installed the next morning.

 in Ontario if you upgrade a furnace to a high efficient new model you receive a rebate back for about 1600 at that time, in order to get this rebate a pre and post installation audit is to be done, proving that the existing furnace was an older less efficient model and that a new high efficient model has been installed in its place.

the company books these audits for its customers and the audits are then completed by a separate energy auditing company once the info is sent to them by the contractor. In the case where a pre audit cannot be done due to timing (like in this lawyers case) some auditing companies allow pictures of the old furnace as proof instead, which was the case for this gentlemen. 

Upon calling in his installation I provided theses pictures to the company I work for and they in turn sent them for approval to the energy auditing company, they approved them and contacted the customer and advised him they will conduct his post audit 2 weeks later.

when they were scheduled to arrive for the post audit the auditor apparently didn't show up and when they contacted him he was now refusing to complete thier audit due to some sort of argument they had about the original appointment. The problem is other energy auditing companies aren't willing to do it either as they didn't receive the information prior to install which is a requirement, and the company that did is not willing to work with him due to his behaviour towards them. 

This means his rebate is at best going to be delayed and he has been harassing me with legal threats for the last week, he seems to be unable to realize this is the fault of the audit company and has nothing to do with me, he saying he is going to sue me personally for fraudulent misrepresentation for thousands of dollars worth of "damages"

ive even convinced the president of the company I work for call him and tell him that they'll just pay him the value of the rebate in good faith as it wasn't his fault the auditor failed to appear, which he gladly accepted, yet he's STILL harassing me daily and saying he's suing me for misrepresentation, I spoke to him on the phone asking him why he keeps threatening to sue me when it was clearly the auditor who didn't attend and my job was done, and he just replies that "you were the one who said there's a rebate so I'm holding you responsible" I told him to go fuck himself and hung up.

since then he has called me 3 times a day (I ignore them) and several texts on how I made a big mistake that's going to be "very expensive" for me. I feel like hes just doing this at this point because I told him to go fuck himself and it pissed him off, he's been reinbursed the value of the rebate by the company yet he still wants to sue me for something outside of my control? He probably knows he won't win but it will cost him nothing and I'll need representation and that's going to cost me more that I have in time and money.

what the fuck am I going to do about this guy lol? Surely there are measures to protect me here or am I just fucked and have to lawyer up?

If you were out there on behalf of the company you work for, you were a representative of said company, and their legal team should have your back. Unless you're an independent contractor, in which case you should have a bond company that is supposed to handle stuff like this. He's being a dick to you because he can be,so get someone from your company's legal staff to shoot him a cease and desist on their letterhead, or file a police report for harassment if you're an independent contractor. If he's going to sue you, nothing you do as an individual will dissuade him, it seems, so bring in someone on your side to balance the scales a bit.

There's more than a few lawyers on here who might be able to provide insight/offer advice, but how this fuckwads is doing it ain't usually how it's done. He might be all bark and no bite, because this kind of harassment is probably illegal in almost any civilized nation, and he should know that. Start keeping a log of all contact (dates, times, duration) and notes about every discussion, just in case this does end up in court and you need to show a judge the pattern of harassment.

Strangely enough, he isn't going after the auditing company or the auditor who skipped his appointment and has refused to go back who caused this whole mess. He's just going after me because I'm the guy he met face to face lol.

Not a lawyer but I've been threatened with lawsuits quite a bit. 

1. Realize most people are full of shit. I've been threatened countless times but I've never actually had to go to court over work shit.

2. People who are going to sue will just do it. They won't call you repeatedly harassing you.

3. Keep proof of all interactions with the idiot and claim harassment with the police. 

4. Document everything. Tell your boss everything. Date and time everything. Phone screens and call logs. Document what was said, threats made, etc. Download a phone call recorder if it's legal in your area. 

I've had some serious assholes on my case threatening me with all sorts of lawsuits. I let them know everything I did and how ready I was to see them in court. Basically begged them for the day off of work to go to court.

The guy is not permitted to receive a double recovery so if he has already received the rebate than he has been made whole and isn’t entitled to anything else. Furthermore, if you performed the work while acting within the scope of your employment, the attorney would have to sue your employer, not you. I don’t know if there are individual state or provincial bars in Canada (in the U.S. each state has a state bar that all attorneys have to be licensed through), but if there are, I would tell the retard that you are going to report him to the bar for his bullshit acts of harassment the next time that he contacts you.

Lastly, based upon the retard’s failure to understand basic remedial legal concepts, I am safely guessing that he is a dog shit of an attorney. Sadly, even as attorney, I will be the first to admit that the occupation is largely occupied by neurotic type A personalities and justifiably warrants a large degree of the public scorn that it receives.

That's a great avenue as well. There has to be some sort of licensing agency up there, and I'd make a formal complaint to them also.

Yes, like the other posters quoted said, he's been made whole. Unless he can list specific material harm you cause (which he can't) or show that you were acting as an individual (you weren't) or did work far outside the scope of what was contracted (you didn't), he's being a miserable prick because he's a miserable prick.

He can sue you, you can sue him, but chances are he won't and I'm betting you don't want the headache either, so you probably shouldn't. If he's starting to make threats like that showing up at other jobs, start thinking about a restraining order. This idiot seems to be some cheese curds short of an order of poutine.

He's going after you because you're a soft target (in his eyes) and he thinks he smells blood. Stop giving him any response at all short of telling him to take it up with your company's legal dept. And file a police report for harassment. The second he gets a call from a Dudley DoRight, I'm guessing he leaves you the fuck alone.

Thank you, this is sound advice, we do have a governing body I believe it is the upper Canada law society and I'll be reporting the asshole to it promptly.

for what it's worth, aside from this dickhead, my experience with lawyers has always been pleasant, granted I've never been sued.

Glad to help, I've been in these type of situations before as a business owner, and as management, and I'm desperately trying to remember the advice my (grossly overpaid) attorney would give the few times he offered "advice" pro bono.

But definitely make your boss and company aware of ALL of this, if you haven't already,  because fuckwads like this will go to them next and try to put some stink on you with them. Get out in front of it and when/if he goes that route, they'll remember about the crazy asshole who'd been harassing you and pay him no mind.
