Marc Emery is in solitary confinement

Emery is currently serving a 5-year sentence for sending marijuana seeds to Americans from his business in Vancouver. He has about 400 more days to go before being returned to Canada.

Marc has taught himself to play bass guitar since he was imprisoned, and has performed with a prison band in 13 concerts for the other inmates.

Marc writes a blog from prison, and in March he was able to get permission from the warden to have somephotos taken of his band practicing in the music room.

“Now the prison has him in solitary confinement to investigate the photos of his band that the prison itself approved!” said Jodie Emery, Marc’s wife. Jodie lives in Vancouver and visits Marc every two weeks. “The investigation is to see if Marc had a cellphone to take the band photos. But the warden, guards, music and recreation administrators, they all know that Marc got official permission for those photos. Yet now they have put him, and his bandmates, into solitary while they ‘investigate’? These investigations can take weeks!”

Jodie was still able to visit her husband on June 7, but visiting hours for prisoners in solitary are limited.

 

“Marc is forced to wear a pair of 4XL shorts with string tied around his waist to hold them up,” explained Jodie, “and only one pair of socks with enormous holes. I cried when I saw him, and he did too.”

Conditions in solitary confinement are not pleasant. Prisoners are kept inside their cell for 23 hours a day.

“His first night in solitary, another prisoner lit a fire and smoke filled all the cells. Marc said he thought they’d die. We need to get him home!”

EMERY APPLYING TO COME HOME

The Seattle Judge who sentenced Marc recommended that he be allowed to serve his time in Canada. And the Seattle prosecutor who indicted and convicted Emery has since called for legalization of marijuana and done media appearances with Jodie Emery.

Yet despite this, when Marc initially applied to serve his time in Canada, the US government refused him. He is allowed to apply again after two years, and just recently he has reapplied to return home. If his transfer is refused again this time, then he will be in the US until summer of 2014.

In 2010, shortly after being convicted in a Seattle court, Emery spent three weeks in solitary confinement. In that case, he was being punished for allowing his wife to record a call made from prison to play as a podcast. This wasn’t expressly forbidden in the prisoner’s rule book, and ultimately Emery didn’t receive any demerit points, but the three weeks in solitary was gruelling.

SOLITARY CONFINEMENT BECOMING COMMONPLACE

Solitary confinement has become a common punishment in American prisons. Some inmates spend years in solitary. In Canada, lengthy periods of solitary confinement are also widely used, with about 800 Canadian prisons in solitary at any one time. Prisoners with mental illness are increasingly put in solitary confinement. The most recent high-profile example is Ashley Smith, who spent four years in isolation before committing suicide.

Groups such as Solitary Watch and the ACLU fight for a reduction in the use of solitary confinement as a punishment, but they have an uphill battle. As privatized prisons spread across the continent, these corporations see solitary confinement as an effective profit centre.

Rastafarians in the US prisons system who refuse to have a haircut for religious reasons have spent over ten years in solitary confinement!

While I don't feel that what this guy did is wrong, he should have known that he would get busted.  Blame the Canadian gov't for allowing him to be extridicted as much as you blame the US.

Hopefully sooner than later what he did won't be considered a crime.

I've read/seen quite a bit on Marc. Used to grab CC magazine all the time. The first one through the wall usually gets bloody, and now apparently huge shorts and solitary confinement, but hopefully this will end up being a positive for MJ reformation here in Canada and down in the USA. i met his wife a few times while she was campaigning for the Green Party in the last election. Very nice looking girl, but now i hate her since i just read she had a reduction....
