i was wondering if you are going to take private lessons does the insructor have to be from the team you train with or can you take from the instructor you prefer

If it's from another team your instructor may get pissed, probably want to clear it first. But it depends on the team.

I would ask your instructor but mine has always encouraged it.

For me I am very lucky to be under an instructor (daniel Beleza) who has a ridiculously profound knowledge, incredibly technical bjj...currently my extra money (if I have it) is better spent on private lessons from him. Im not saying that I would learn nothing from a seminar...in fact, the contrary. I am saying I would learn more from a private lesson with my instructor.
