so some background. my wife is friends with my kids middle school vice principle (a female)
yesterday my wife got a text message from her letting her know that our middle daughter 13 years old had her butt grabbed by a kid at school (second time that we know about this year)
after the last time we told my daughter she's free to defend her self
so when we asked her about it last night she said she slapped the kid.
the vp told my wife she'd look into it more today and let her know. well we just found out the vp is on a school trip in the morning and wont be back until afternoon.
but my wife just got a call from the school guidance counselor. she said she talked to the boy and the boy admitted he did it and then said that after my daughter slapped him, he either "grabbed, pushed or slapped" (she wasn't clear) her back and that my daughter slapped him again after he did that.
and that because of school rules they have to have a zero tolerance on "violence at school" and so they are punishing her. the punishment is to not allow her to take part in an end of the year activity.
my wife wants me to wait until the vp gets back to school and let her talk to the vp before i go to the school and flip out on them.
if it's not handled properly i might end up in jail on monday.
as for now my wife went to pick up my daughter from school and is taking her to her work to let her hang out there with her and help with the clients at the special needs day care she works at. and will reiterate she will not be punished by us in any way for this.
Just threaten to take it to the media and put THEM in the news instead.
In today's climate, they would LOVE a story about a school punishing a girl for defending herself from the sexual assaults they fail to stop. They'd all be on the news apologizing and resigning/being fired in no time..
Whats important is that your kid learns early on that only daddy state can defend her. She should not be able to defend herself that leads to dangeroud territory like the development of the individual.
then I hope the VP will handle appropriately. everyone has the right to self defense.

I don't think bringing the law or even raising it will help in this case. So she didn't violate the law. Ok. No one is saying she did, which is why no legal action was taken.
School disciplinary regulations don't have anything at all to do with the state law. They are two totally separate arenas.

Parent and teacher here... Wait for VP on Monday. I’d imagine VP has overriding authority to decide on the punishment (switch to an after orbout of school suspension = who cares). If no remedy from this, then do whatever you feel appropriate. Media would be a powerful tool.

this law is the "RIGHT to SELF-DEFEND" law
if the school (government) is going to punish her for acting on her rights then its relevent.
the breaking the law is by the school by punishing her and that they will be held liable for infringing on her right to do such.
