One definition of mechanical asphyxia is caused by a blockage of air to the body causing death.

Does that means a air choke as opposed to blood choke?

The other definition has compression of the lungs much like in a trampling death where people think a person died of blunt force trauma but it is actually that death is caused by the inablity to expand the lungs due to the "weight" of the crowd.

So either the guy applied a air choke or the weight of the two guys on top of him did not allow his lungs to expand once he blew out his breath. Or a combination?.

The death of a 33-year-old California man, who died July 6 after he allegedly stole beer from a Waikiki convenience store and was subdued by two people, has been classified as a homicide, the city medical examiner's office said.

Humberto Murillo, 33, of San Fernando, Calif., died of "mechanical asphyxiation" which meant that he was held down while lying on his stomach and his breathing was restricted, the medical examiner's office said.

Police initially classified the case as an unattended death and a robbery.

Murillo allegedly took two 12-packs of beer without paying for them from an ABC Store at the Hyatt Regency Waikiki Resort & Spa July 6.

Police said Murillo walked out of the ABC Store at the Diamond Head end of the hotel at 2424 Kalakaua Ave. with a couple of cold packs of beer. The cashier notified her manager, who found Murillo on the second floor of the hotel and asked him for a receipt, police said.

Witnesses said the men struggled in front of a golf shop. Murillo began assaulting the 29-year-old manager, police said. The manager called for help, and a 20-year-old hotel guest responded by helping to subdue Murillo, police said.

City paramedics took Murillo to Straub Clinic and Hospital, where he was pronounced dead.

how the fuck do they classify that as a homicide?? what's this world coming to where the criminals have more rights than the victim. this is absurd.

I think it is just the cause of death not charging anyone yet?. The medical examiner has to determine a cause of death. They determined that this person died due to Mechanical asphyxia. You know like saying someone died due to blunt force trauam, heart attack, stroke, exsanguination etc. Thats just the reason why the person died.

In stating the cause of death, the medical examiner must determine how the person died. So, in other words did he kill himself. No.

So thats means by death caused by another = homicide.

It is up to the homicide detectives to charge someone. They have to do a hell of a lot of investigations into the witnesses and what the "victim" was doing, saying, etc. Then see if they charge anyone with a crime of homicide. They might decide that they do not have enough evidence to convict someone. Good Samaritan law. Criminal threatening to kill the store owner if he was let go etc. If anything they could try negligent homicide but that would be hard to prove to a jury.
