This is going to be a long read for anyone who has a moment. I basically had the same situation as Mike Bisping. This is the write up that my lawyer had me do for her. I apologize in advance for any grammatical errors. I'm running out of time to file a claim. The lawyer I've been dealing with says it's a hard case to prove. She doesn't know if her partners are willing to invest. I just wanted to see if there is anyone out there that could give me some advice, thanks.
This is the document you requested to explain what has transpired over the last 9 months with my retina injury and the subsequent surgeries performed. Let me start at the very beginning when the actual injury MAY have occurred. It was in early 2009, I was assaulted by a stranger at a local party I was attending. I never found out who the individual was. They struck me with a single blow to my left eye. I did not file a police report because at the time I didn’t think that there was any real damage done. Plus the man had got away before anyone could stop him.
I went about my life as normal, attending school and work not giving much thought to what had happened that night at the party. Slowly over time I started to notice that my peripheral vision was starting to cape over in my left eye. It was barely noticeable at this time. Just to be certain though, I decided to go to an ophthalmologist by the name of Dr. Nye and have my eyes examined. This was around 6-8 months after the initial injury. The doctor was unable to find anything that would be causing the problems I was describing. So after this visit I had just assumed that whatever was going on there was nothing that could be done about it. Years past and although my peripheral vision in the left eye did slowly start to cape towards the middle of my vision, the eye itself looked healthy.
It was in March of 2013 that I needed to get both my eyes examined for a check up on my contact lens prescription. I went to Peal Vision and had an examination done. While I was there, I told the doctor about some of my issue and concerns I was having in relation to my left eye. After she had examined the both eyes and had my prescription decided, she went ahead and looked at the back of my left eye and noticed that there was a tear in my retina. She told me that the only thing she could really do is identify the tear and that I was going to have to see a specialist about it. Before I left the office she had made me an appointment with a retina specialist that they refer their patients to on a regular basis. His name was Dr. Haroon A. Chaudhry. My appointment was to be the same day the following week at his office on 563 Wessel Drive Fairfield OH.
Upon meeting Dr. Chaudhry he explained that I should not be nervous about the possibility of surgery to repair the torn retina. In fact, I was one of if not the youngest patient he’s had. When I was in the waiting room I noticed this immediately. I was the youngest person there by 30 years. He also gave me a nice statistic that gave me peace of mind. That the surgery I would need had a 98% success rate. He also stated that youth would only benefit the healing process. So after Dr. Chaudhry examined me and did in fact find the tear. We discuss when the surgery would need to take place. I had concerns about being able to get off work for the surgery and recovery. I didn’t want it interfering with my job. Dr. Chaudhry told that if the tear had happened in 2009 then there was no real rush to get into surgery.
So before I left the office I had agreed to the surgery. He was planning on doing two different procedures. One was called a vitrectomy where they laser the tear and put a oil substance in the eye along with a gas bubble to hold the retina in place. The other procedure was called a visceral buckle. This is basically a band that they place around the back portion of the eye and it presses the outside of the eye in against the retina. I decided to sign off on both procedures. I left the office that day without a set surgery date because I wanted to see if I could get off work. I felt no real rush though because Dr. Chaudhry felt there was no real urgency. I had scheduled for the surgery around mid April but had to have the surgery moved to May 1st. The surgery was to be performed at the Tri-Health Evendale hospital. After the surgery Dr. Chaudhry told me that he had only done the vitrectomy with the gas bubble because he felt that’s all that was needed.
I went home to recover and I was going to have to see go back into Dr. Chaudhry’s office the following day to have the eye examined. The first check up was fine and the retina was still in place. He asked me to come back a week later for another follow up examination. This examination went fine as well. My eye started to bother me the day before the third examination. I just attributed it to the trauma of the surgery itself. The next day I went to Dr, Chaudhry’s office and he examined my eye and said that the eye had retore and that the tear was actually bigger then last time. He then asked me if I would like him to refer me to another doctor. I declined because I felt he understood my situation since he had been there at the start. He said that he wanted to go back in and try to repeat the surgery this time placing the buckle behind the eye. At this time I had also developed a cataract in the left eye from the post-op steroid eye drops I was on. He decided that he wanted to have the cataract removed during the second surgery. The doctor who performed the cataract surgery was Dr. Chandook.
The second Surgery was performed on June 7th 2013. It was done at the same hospital as before, Tri-health Evandale. Everything seemed to be going just as before did. When I was awoke after surgery Dr. Chaudhry explained to me that he was unable to repair the tear. He had gone ahead and installed the visceral buckle and Dr. Chandook had preformed the cataract surgery though. My girlfriend who had attended all of my surgeries told me on the way home that Dr. Chaudry could not explain what had went wrong and became somewhat emotional about it when speaking to her in the waiting room.
The day after the second surgery I went into Dr. Chaudhry’s office and he told me that he was going to make some phone calls to see if he could find another retina specialist to try and fix the ¾ tear in my retina. He said that he had two doctors in mind. One was in Ohio, the other was in Tennessee. The one in Ohio declined his services. The doctor in Memphis Tennessee didn’t however. His name was Dr. Steve Charles of the Charles Retina Institute. So two days later I was headed to Memphis to possibly have surgery again. Once I had arrived and seen Dr. Charles, he decided that it was too soon to do another surgery on the eye at this time considering I had surgery not even a week before. Something that I had asked Dr. Chaudhry about being concerned it was too soon. He simply said it was not.

I then scheduled my third surgery to be done on June 26th 2013 in Memphis Tennessee at the Charles retina institute. Dr. Charles said that the prognosis was low for the eye but he was going to do what he could to salvage it. He ended up removing half the damaged retina. He told me that the success of the surgery could be determined later on. It was also during this surgery that I had my two front teeth knocked out after telling three different staff members at the facility that my front teeth were crowns. That’s a whole other situation in itself though.
Once I had returned to Ohio I saw Dr. Chaudhry just one time. He examined my left eye and checked the pressure a few days following my return. He asked me to come back in about a week to get another follow up. During this week though, I received a call from his office requesting a payment by the next time I come to the office for my scheduled examination. I had not worked in several months due to this injury however and I could not afford to see the Dr. Chaudhry. A few months went by without hearing anything from Dr. Chaudhry then around September I got a call from his office asking me to come in and be examined and that it was going to be completely free of charge. I decided against this though. It’s now been 6 months since the second surgery and my left eye continues to shrink and show discoloration, as well as an increase in pain. I have yet to see another retina specialist but am doing so in the following weeks. I’m expecting the worst though. The eye will be more than likely removed. I appreciate you taking the time out of your busy schedule to consider my case. I hope we have the opportunity to work together so I am able to have some peace and restitution from this awful situation.
