That may be the case in your state; it just happens that Patry is a resident of Quebec and, this being a defamation matter, the tribunals of the province of Quebec would have jurisdiction and Quebec law would apply.

Now, Quebec is a province of Civil law, where strange things sometimes happen. Without going into detail, one of those strange things is that a truthful statement can be defamatory insofar as it is uttered with the willful intent, for instance, to subject a person to public ridicule and contempt.
