All the second kid had to do was step away a few feet nd they would have left him alone. Instead they both chose to run their mouths, refuse orders to turn around, and basically act like assholes the entire time. Yes, they were embarrassments.
They told him to leave, then he explained why he had to stay there. Josh is former military, he should know that you never leave the person you are with. The dude was being cordial, then with out warning, josh hems him up.

The cops had no option but to deal with the beer-stealing kid and it's probably SOP to cuff the other dude. There's always a chance he could freak out and jump one of the cops or something ridiculous like that. Beer Stealer put himself and his buddy in that position.
